I'm not sure what's gone wrong there - I've tried replicating what you did (as well as leaving the box unchecked during expansion, then taking over the team via commissioner mode after expansion) and I still have all the action menu options available when the draft begins. Are you going to the draft screen via the "NHL Expansion Draft" link under "Today's Event" on the Team + League Controls menu?
