I've started a Historical game with Iron Curtain unchecked. When I simmed forwards to 1970, I noticed that the rule was enabled again. I started a new game and verified that Iron Curtain was unchecked in the game settings. I simmed a decade at a time and at some point after the 50's, I forget exactly sadly, the option checked itself again. I unchecked it and continued simming and it stayed unchecked from then on.

As a side note, I've now simmed to 1970 and took over the Canucks 4-5 times and every time the Canucks have gotten first pick in the expansion and entry drafts. That's not a huge sample size so i might have just gotten lucky though so I don't know that I can actually call it an issue at this stage.
