No, you can definitely finagle things so that's not the case. I've done it (I'm currently playing with 17 in each league). The expansion draft worked just fine for me when I did that. Unfortunately, I have nothing to add as to why the expansion draft here in this specific case broke, though. It sounds like he did exactly what I do when I did it.
