Independent Affiliated/Unaffiliated

Currently, I have an Independent league unaffiliated with the Top League ina Custom set-up..

If I were to set them affiliated with the Top league still as an Indy League, but make all teams unaffiliated with individual teams .... would the Indy League sign and have access to the Reserve Roster players as the Top league only have reserves not any affiliated minor league system

...OR perhaps, it is not necessarily structure .. but contracts??? Is there any way to make a player free but still the TOP team maintain rigths to them??

No, currently the game does not have that functionality. Indy Leagues can only sign guys who are free agents, if a player is on a reserve roster, they are "contracted" to that team and no other team can sign them. You are looking for some kind of loan system, similar to hockey and soccer. The MLB is looking at having some kind of partnership/loan system with the new Independent Pioneer League, but nothing has been announced yet, so I am sure that it will eventually end up in the game once they announce the details and Markus, Matt and crew can figure out how to implement it.

If you affiliate a league to the top league but don't affiliate teams, they will still act independently and sign free agents, but I believe they will only sign minor league contracts, but again guys on reserve rosters will not be able to go there.
